2021 Official Game Rules

THIS GAME IS DEVISED AS A SKILL AND KNOWLEDGE-BASED, NON-GAMBLING PROMOTION AND IS INTENDED SOLELY FOR ENTERTAINMENT PURPOSES. NO PURCHASE, CONTRIBUTION OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. VOID WHERE PROHIBITED.

FOOTBALL OUTSIDERS ACCOUNT IS REQUIRED TO PARTICIPATE (FREE TO SIGN UP).

1. GAME: This Football Outsiders Loser League Challenge ("Game") is a fantasy sports contest to pick the worst players in fantasy football each week during the 2021-22 NFL Regular Season.

The Game begins with the commencement of the Registration Period (as defined below) at 8:00 a.m. Eastern Time (“ET”) on August 18, 2021 and ends at 11:59:59 PM ET on January 9, 2022 (“Game Period”).

Participation in the Game is subject to the provisions of these official rules (the “Official Rules”).

2. ELIGIBILITY: The Game competition (as described below) is open only to individuals who, as of the beginning of the Registration Period (as defined below) are: (i) legal residents of the United States (including D.C.) (the “Eligibility Area”); (ii) at least eighteen (18) years of age or older and the age of majority in the state of residence, as of the time of registration; and (iii) a registered Football Outsiders account holder. The Game competition, and where applicable, the Game, is VOID outside of the Eligibility Area or where prohibited or restricted. Except as otherwise expressly set forth in this Section 2, employees and directors of EdjSports, LLC (“Sponsor”), and each of its respective affiliates, subsidiaries, franchisees, advertising and promotional agencies and other partners), and their respective officers, directors, employees, and agents, the immediate families of such persons (defined as spouse, child, sibling, parent or grandparent or so-called “step” or “half’ variations of any of the preceding individuals), and those living in their same households, are ineligible to win or collect prizes in the Game. Only individuals meeting all eligibility requirements set forth in these Official Rules, who validly and properly register for the Game as set out in paragraph 3 below, may participate in the Game and win a prize (“Players”). Additional entries from any individual using different e-mail addresses will be disqualified and destroyed. Each Player’s Registration or participation in the Game constitutes and is deemed such Player’s full and unconditional agreement to the Official Rules and any and all decisions of Sponsor and any third-party judges, which are final and binding in all respects. Players agree to waive any right to claim ambiguity in the Game and/or these Official Rules.

3. HOW TO REGISTER: At any time between 12:00 p.m. ET on August 17, 2021 and 1:00 p.m. ET on January 9, 2022 (the “Registration Period”), each Player must visit https://www.footballoutsiders.com/fantasy/loser-league (the “Site”) and follow the on-screen registration instructions to register for the Game and acquire access to the Game portion of the Site (“Registration”). THERE IS NO ENTRY FEE TO PARTICIPATE.

Limit: one (1) Registration per person/email address.

Where applicable, Players may use a previously created login to participate in the Game. By participating in the Game, previously registered Players acknowledge and agree they have read and accept these Official Rules. Each Player’s registration must be associated with a single email address. Each Player may use only one email address to participate, and the same email address may not be used by more than one Player. If any Player uses more than one email address to play this Game or if more than one Player uses the same email address to play this Game, Sponsor reserves the right to disqualify all Game plays associated with the Player(s) and email address(es) involved. Additionally, Sponsor reserves the right to block and/or remove league or team names and their associated accounts in the event Sponsor determines, in its sole discretion, that the league or team name is inappropriate, obscene, or in violation of applicable laws, regulations, or platform policies.

4. HOW TO PLAY/ACCRUE POINTS: The Game consists of 18 weeks of NFL Regular Season games in which Players earn points based on the performance of their fantasy team as shown in the table below. NFL Regular Season game dates and details shown in the table are subject to change; notice of any such change will be posted on the Site.

1. Game Play: Players must draft a team of NFL players and create a team roster to play each week during the NFL Regular Season (a “Team”).

Each Team roster will consist of: 2 Quarterbacks, 3 Running Backs, 3 Wide Receivers, and 2 Kickers.

To play, at any time prior to the Entry Deadline (as defined below), Players will log-in to the Site and fully complete one (1) entry for the current NFL Week’s games (“Weekly Entry”) by selecting their Team of 10 players from among the Football Outsiders-provided roster, in each case trying to select the players for such Week’s Team that will earn the lowest number of points in that Week’s games. If a selected player on your Team does not play in the Week’s game for any reason (including, but not limited to, injury, suspension, bye-week, inactive, postponement, COVID, etc.), the Team is subject to the same scoring for such player’s position as noted below (e.g., if a selected Quarterback does not play in such week’s game, the Team is awarded 18 points because such selected Quarterback had fewer than 10 passing attempts in such week’s game).

Players may change their Weekly Team Roster at any time up to game time. All Weekly Entries must be submitted electronically no later than the earlier of (i) the NFL kickoff time for a selected player’s team’s weekly game; or (ii) when such game is played (“Weekly Entry Deadline”). For example, a Quarterback playing at 12:00 p.m. on Sunday in Week 1 must be added to a Team Roster no later than the earlier of kickoff time or when such Week 1 game is played.

If a Player fails to submit a Weekly Entry before the Weekly Entry Deadline, such Player’s Weekly Entry from the week prior will be entered. The clock on Sponsor’s database server shall be the official timekeeper for this Game.

Weekly Entries may be revised and re-submitted at any time prior to the applicable Weekly Entry Deadline. Players may submit only one (1) Weekly Entry, as applicable, for each Week. Additional Weekly Entries from any individual, using different e-mail addresses or any other system of multiple entries, will be disqualified. Lost, late, illegible, incomplete or misdirected Weekly Entries are not eligible. Players will earn the number of points that are equal to the total number of official points earned by, and credited to, the players on Player’s Team in each Week (according to the official statistics as of the end of the applicable game) (“Weekly Score”). For purposes of these Official Rules, the cumulative sum of all of a Player’s Weekly Scores, as computed following the end of any given Week, shall be deemed such Player’s “Total Game Score.”

2. Scoring

Your Team is comprised of real-life NFL players, and the statistics that those players accumulate are based on their real-life performances throughout the course of this Game. The scoring system applies to all members of Your Team. Points are awarded to each of your Team’s players in each game based on the following scoring system:

• 1 point for each 20 yards passing

• 1 point for each 10 yards rushing

• 1 point for each 10 yards receiving

• 4 points for each passing TD

• 6 points for each rushing or receiving TD

• -2 points for each fumble or interception (note: fumbles/interceptions by Special Teams do not count)

• 3 points for each field goal made

• 1 point for each extra point made

• -2 points for each missed field goal

• -5 points for each missed extra point

 

     Penalties

• 18 points for any Quarterback who has fewer than 10 passing attempts in a game

• 15 points for any Running Back who has fewer than 8 rushing attempts in a game

• 15 points for any Wide Receiver who has fewer than 3 targets in a game

• 12 points for any K who is not active or has no attempts but another K on his team attempts a kick for any reason

 

The total score for a Week is determined by disregarding the highest score for each position on your Team. For example:

Note: the Game’s scoring model will not include the NFL's midweek statistics corrections.

3. Determining Prize Winners

Subject to these Official Rules, the individual Player with the lowest Weekly Score upon the conclusion of each Week, will be the Week’s designated loser (“Weekly Loser”).

(d) Grand Prize Loser

Subject to these Official Rules, the Player with the lowest overall score for the entire NFL Regular Season will be the “Grand Prize Loser”.

(e) Tie-Breaking Procedure

In the event of a tie for any Weekly Score or Total Game Score, the following tie-breaking procedures will apply, in the order set for the below, to determine the winner of the tie-break. The lower score in each tie-break will be declared the winner.

1. The Raw Score from all ten members of the tied Teams.

2. If there is still a tie, the Raw Score from the two QBs on the tied Teams

3. If there is still a tie, the Raw Score from the three RBs on the tied Teams

4. If there is still a tie, the Raw Score form the three WRs on the tied Teams

Season Totals Tie-Break

1. The sum of all week's Raw Scores from all ten members of the tied Teams

2. If there is still a tie, the sum of all week's Raw Scores from 2 QBs on the Tied Teams

3. If there is still a tie, the sum of all week's Raw Scores from 3 RBs on the Tied Teams

4. If there is still a tie, the sum of all week's Raw Scores from 3 WRs on the Tied Teams

Winner of the tie-break is Team B, as Team B has a lower Raw Score in the first tie-break.

(e) Runner-Up Loser

Subject to these Official Rules, the Player with the second-lowest overall score for the entire NFL Regular Season will be the “Runner-Up Loser”.

• Grand Prize: The Grand Prize Loser will receive a Super Bowl package that includes:

  • Two (2) tickets to the Super Bowl in Los Angeles on February 13, 2022;

  • Flights for two originating from the US city closest to winner’s home, as determined in Sponsor’s sole discretion;

  • Hotel arrangements with check in on Friday, February 11 and check out on Monday, February 14, 2022

  • ARV: $20,000

Tax gross-up: Sponsor will also provide the Grand Prize Loser a single cash payment in the form of a corporate check, which is intended to assist the winners with any federal, state, or other tax obligations related to the prizes (the “Tax Gross-Up Payment”). Grand Prize Loser’s actual tax liabilities related to the prizes could exceed the Tax Gross-Up Payment it receives. The Grand Prize Loser is solely responsible for all applicable federal, state, or other tax obligations related to the prizes. Sponsor will not provide any further assistance toward the Grand Prize Loser’s tax obligations.

• Runner-Up: The Runner-Up Loser will receive a PlayStation® PS5 gaming system.

  • ARV: $535

Any difference between stated approximate retail value and actual value of Prize will not be awarded.

All prizes are awarded “AS IS.” Sponsor and Sponsor affiliates do not make or offer any warranty or guarantee, either express or implied (including, without limitation, quality, merchantability and fitness for a particular purpose) in connection with this Game or any prize. Prize details and availability are subject to change, in which case a prize of equal value may be substituted at Sponsor’s sole discretion. Prizes consist only of the items listed, are non-transferable, with no cash redemption or substitution except at Sponsor’s sole discretion. Prize winner may be required to show a valid photo identification, valid driver’s license, or other acceptable government-issued identification to verify identity and redeem prize. Prizes are subject to terms, conditions, expiration dates, and restrictions imposed by the manufacturer/issuer of the prize. No refund or compensation will be paid in the event of the cancellation or delay of any portion of the prize, or any portion thereof. Sponsor will not be liable if any event, or any portion of it, is cancelled or delayed. Sponsor may, in its sole discretion, attempt to reschedule for a future trip/event. The terms and conditions of the event tickets may govern if the event is cancelled due to weather, an act of God, an act of terrorism, civil disturbance or any other reason. Sponsor is not responsible for, and will not replace, lost, mutilated, or stolen event tickets, vouchers, wristbands, or certificates. Exact details, including seat locations, shall be determined in the sole discretion of Sponsor. Federal, state, and local taxes on prizes, if any, and any other costs, fees and expenses not listed above as specifically included as part of the prize are the sole responsibility of winner.

Travel-Related Prizes: All travel arrangements must be made through Sponsor’s agent. Any other costs and expenses associated with prize acceptance and use not specifically provided herein (such as security fees, gratuities, luggage fees, meals and transportation, service charges or facility charges, personal charges at lodging, security fees, taxes, and all other expenses not specified above) are the sole responsibility of winner(s). Prize winner may be required to present a credit card at time of hotel check-in. Ground transportation may be provided in lieu of air transportation if winning entrant resides within a 100-mile radius of destination, and no compensation or substitution will be provided for difference in value. Guest of each winner must meet Game eligibility requirements. Each winner and their guest must possess and show valid travel documents, prior to departure (e.g., passport, visa, valid driver’s license, or other acceptable government-issued identification), and must sign a Release of Liability/Publicity and any other documents provided to him or her prior to ticketing. Once airline tickets have been ticketed, no changes will be permitted. Sponsor will determine airline, airports, flight itinerary, and hotel in its sole discretion. Travel and accommodation restrictions, conditions, and limitations may apply. Sponsor will not replace any lost, mutilated, or stolen tickets or travel vouchers.

Sponsor and its respective employees, contractors, directors and officers, and their respective parents, subsidiaries, franchisees, divisions, affiliates, suppliers, distributors, advertising and promotional agencies, as applicable, and their respective officers, directors, shareholders, members, employees, agents, successors and assigns, and all others associated with the development, promotion, evolvement and execution of this Game, are not responsible if the prizes, or any part thereof, cannot be awarded due to delays or interruptions due to any acts of God, public health crisis, action(s), regulations(s), order(s), or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulation(s), order(s), or request(s) prove to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond Sponsor’s sole control, and shall not be responsible for any cancellations, delays, diversions, or substitutions or any act or omissions whatsoever by any other persons providing any of these prizes.

6. PRIZE AWARDING:  Prizes will be awarded after confirmation of eligibility and, if applicable, execution of requested eligibility and release documents. All prizes will be awarded if claimed. Unclaimed prizes will not be awarded. Winners will be responsible for any and all federal, state and local taxes incurred in winning and accepting any prizes and all other expenses incurred in winning and accepting the prizes. Winners may receive an IRS 1099 form reporting the value of their prize. All Winners will be initially identified, subject to eligibility, no later than on or about 12:00 p.m. EST on the Tuesday following the date of the Weekly game, by Sponsor or its agent, whose decisions are final and binding. Winners will be notified by email, at Sponsor’s discretion, and must respond to the notification within five (5) days of the date sent or his/her prize may be forfeited in Sponsor’s sole discretion. Sponsor is not responsible for any change in a Player’s mailing address, email address and/or telephone number. Each Winner must provide positive identification in such form as is specified by Sponsor to claim his/her prize. Prize Winners may be required to sign an affidavit of eligibility and liability release and return it within ten (10) days of Sponsor’s request (except where void or prohibited by law). Winning and claiming a prize is contingent upon Winner’s provision of all information requested by Sponsor, in the Notification or otherwise, subject to applicable law, and upon Winner eligibility, validation and verification, as determined by Sponsor.  All prizes must be redeemed by each Winner no later than five days following Sponsor’s confirmation of Notification. In the event of a dispute as to the identity of a Player or Winner, the individual who was, at the time of Registration, as determined by Sponsor, the documented registered holder of the email account used in connection with Registration for the Game will be deemed the eligible Player or Winner, as applicable. Players are solely responsible for notifying Sponsor during the Game Period if his/her email address or any other contact information changes. Prizes may not be transferred, and any transfer will result in forfeiture. In no event will more prizes be awarded than those listed above in Section 5. Sponsor reserves the right to substitute any prize with either the cash value of such prize or a prize or prizes of equal or greater value in the event any stated prize becomes unavailable.  If a Winner cannot be contacted within the specified time period, is ineligible, fails to claim a prize, or if a Notification or prize is returned as undeliverable, the prize will be forfeited, and an alternate Winner will be selected, in Sponsor’s discretion. For purposes of this Game, the alternate winner, if necessary, will be the Player with the next-lowest score immediately following that of the disqualified Player, as determined by and set forth in these Official Rules. Sponsor reserves the right to award equal prizes to any tied Players as long as the sum total of such prizes is equal to the ARV of the designated prize.  Acceptance of a prize constitutes permission for Sponsor and its respective designees to use of Winner’s name, address, likeness, statements, voice, and biographical information for promotional purposes in any media without notice, further payment, consideration, credit, or right of approval or review (except where void or prohibited by law).

7. GROUNDS FOR DISQUALIFICATION: The use of robotic, automatic, macro, programmed or like methods (including without limitation the use of any promotion/game subscription, notification, entry or like sites or service that offers Round Entry services "on behalf of" Player) is strictly prohibited and any Player using or suspected of using such methods may be disqualified. Persons found tampering with, hacking, illegally registering for or abusing any aspect of the Game will be immediately disqualified, in Sponsor’s sole discretion. If disqualified for any of the above abuses, Sponsor may immediately terminate that Player’s participation in the Game and future games or contests by Sponsor and Player will be ineligible to win. Any violation set out in this Rule or other attempt to damage any website of Sponsor, or tamper with or undermine the legitimate operation of the Game, is a violation of these Official Rules, as well as any and all applicable criminal and civil laws. Sponsor reserves the right to seek remedies and damages from any Players or individuals acting in concert with any Player to the fullest extent permitted by law. In the event any portion of this Game is compromised as determined by Sponsor, Sponsor reserves the right to modify, suspend or terminate the Game. If the Game is terminated, Winners will be determined from among all eligible Players based upon the applicable scores for such Players as of the date of such termination.

8. LIMITATION OF LIABILITY: By registering for and participating in the Game, each Player agrees: (a) to comply with these Official Rules and the decisions of Sponsor and any third-party judges, which shall be binding and final in all respects; (b) to comply with Sponsor’s privacy policy, available for review at www.footballoutsiders.com/info/privacy-policy; c) to release Sponsor, each of its respective affiliates, subsidiaries, franchisees, advertising and promotional agencies, and each of their respective parent companies, affiliates, subsidiaries, wholesalers, retailers, distributors, dealers, advertising, and promotion, fulfillment, marketing agencies, public relation firms, consultants or contractors and each of their respective employees, officers and directors (“Released Parties”) from all liability, loss or damage arising out of participation in the Game; and (d) that he/she acknowledges that Sponsor makes no warranty, representation, or guarantee, expressed or implied, in fact or in law, and disclaims all liability for the provision, quality or nature of any third-party decisions affecting the Game, and third-party products or services provided in the Game (including, without limitation, the footballoutsiders.com website and platform), to Participants, and to Winners. By participating in the Game, each Player releases Released Parties from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons (including personal injury, death and/or property damage, as well as any claims based on publicity rights, violations of protected speech rights or invasion of privacy) and property that may be sustained in connection with participation in the Game. IN NO EVENT WILL THE RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING WITHOUT LIMITATION INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, ARISING OUT OF ANY PARTICIPATION IN THE GAME, INCLUDING WITHOUT LIMITATION, PERSONAL INJURY, DEATH AND/OR PROPERTY DAMAGE, AS WELL AS ANY CLAIMS BASED ON PUBLICITY RIGHTS OR INVASION OF PRIVACY. Players further agree that (a) all causes of action arising out of or connected with this Game, shall be resolved individually, without resort to any form of class action; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs; and (c) any cause of action arising out of, relating to, or in any way connected with any of released parties or any part of the promotion must commence within one (1) year after the cause of action accrues; otherwise, such cause of action shall be permanently barred.

 

9. PLAYER, GAME AND SITE INFORMATION AND CONTENT: Any information provided to Sponsor by a Player in connection with Registration or otherwise, including Players’ names, addresses, telephone numbers and e-mail addresses, will be used to administer the Game, communicate with Players in connection with the Game providing necessary notice, or as otherwise in compliance with these Official Rules. Limited to the purposes outlined herein, Sponsor will collect, use, and protect personal data in accordance with Sponsor’s privacy policy. Use of the internet, generally, shall be at Player’s sole risk. Any personal information transmitted by a Player over the internet, including Player’s names, addresses, telephone numbers and e-mail addresses may not be secure and such transmission is at the Player’s own risk and Sponsor shall have no liability in connection therewith. All data is proprietary to Sponsor and will not be returned to Player. Players are strongly cautioned to exercise judgment and safety in the disclosure of personal information, understanding that no on-line site or activity is completely impervious to outside intervention or activity regardless of the level of security employed by Sponsor and that such information may be accessible to third parties. No Player may attempt to attach any link, ancillary portal or sub-site or upload or otherwise display any content on the Site or within the Game without the express written permission of Sponsor, which may be withheld for any reason. Sponsor is not affiliated with, endorsed by, or licensed by any of the players, teams, or their sponsors, professional or trade associations, organizations, including those organizations referred to or identified by the National Football League or any other entity, award, honor or individual identified in the Game or its promotional materials and none are sponsors of or associated with the Game in any way. Any of their names, brands, identifying terms and/or designations, including any embedded or associated trademarks, logos and images (“Third-Party Materials”) found on the Site are the trademarks, brands or other protected content of their respective owners and are used for acceptable, valid, and appropriate factual, descriptive, identification and non-trademark purposes only and Sponsor is not the owner of, nor has any interest in, the Third Party Materials, including as a licensee. The Site is intended for informational and entertainment use only. Any and all software, platforms, page or menu organization, components, content, play mechanisms, proprietary functionality, graphic or text materials, trademarks, service marks, brands, logos, slogans, names, music, photos, videos, sounds or any other materials in or on the Game or the Site that are not Third-Party Materials (“Protected Materials”), including all acquired goodwill and market recognition associated with the Protected Materials are the exclusive, valuable intellectual property of Sponsor, subject to copyright, trademark or other statutory protection, and may not be copied, used, distributed, adopted, merged, or appropriated for any purpose without the prior express written permission of Sponsor.

10. GENERAL INFORMATION: THIS GAME IS DEVISED AS A SKILL AND KNOWLEDGE-BASED, NON-GAMBLING PROMOTION AND IS INTENDED SOLELY FOR ENTERTAINMENT PURPOSES. The Game is VOID outside of the Eligibility Area or where prohibited or restricted. Sponsor is not responsible for lost, interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer or telephone transmissions or technical failure, jumbled, scrambled or misdirected transmissions, other error of any kind whether human, mechanical or electronic, problems or technical malfunction of any telephone network or lines, computer systems, servers, access providers, equipment, or software, failure of any e-mail or entry to be received for any reason, traffic congestion on the internet or at any website, or any other technical problems related to website entries or any combination of the foregoing, including any injury or damage to a Player’s or any other person’s computer. Sponsor reserves the right to modify the Official Rules at any time for purposes including, but not limited to, adding additional games and prizes, of clarifying and effectuating how the Game should be played, how the Game will be scored, how Winners are determined, how tie-breaking procedures are applied and how unanticipated ties are resolved. Any changes to the Official Rules will be reasonably made with the intention of not materially affecting the terms and conditions of the Game. In the event of inadvertent computer or operator error, the illegal or inappropriate activity of any Player or unrelated third party, the unanticipated application, failure of Site function, effect of Game mechanisms of play or individual components, software or hardware, any change of law, general market conditions or industry custom relevant to identical or similar programs or games, any force majeure events affecting the commencement, timing, operation, schedule(s) of registration, Player entry, Rounds or entry deadlines, the accrual or calculation of points, the determination, notification or posting of Winners, the application of tie-breaking procedures, Sponsor reserves the right to modify, revise, add-to, nullify or utilize only in part the stated timing, commencement or termination of any round, period, entry or promotion period or schedule and/or, in its sole discretion, to implement substitute rounds, periods, entry or promotion periods or schedules, or portions thereof, solely for purposes of conducting the Game in a fair and reasonable manner and determining Winners on an equal basis and without unfairly disqualifying otherwise eligible Players from winning. All applicable federal, state and local laws and regulations apply. Any and all disputes in connection with the Game will be resolved exclusively in the appropriate courts in the State of Indiana without regard to conflict of laws principles. Each Player waives any and all objections to jurisdiction and venue and hereby submits to the exclusive jurisdiction and venue of courts in Indianapolis, Indiana. The failure of Sponsor to exercise or enforce any right or provision of the Official Rules shall not constitute a waiver of such right or provision. If any part of the Official Rules is held by a court of competent jurisdiction to be invalid or unenforceable, that part will be enforced to the maximum extent permitted by law and the remainder of the Official Rules will remain fully in force.
